Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the FalconMC Minecraft server, website (falconmc.org), and associated Discord server (together, the "Service"), operated by the founders of FalconMC ("FalconMC," "we," "us," or "our").

By creating an account, connecting to the server, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to create an account or use the Service. By registering, you confirm that you meet this age requirement. We rely on this self-certification (age gate) at signup; we do not independently verify age.

If we become aware that a user is under 13, we reserve the right to suspend or terminate that account.

2. Accounts

Accounts are created and linked via Discord OAuth, and you are required to link a valid Minecraft account to use the Service.
You are responsible for maintaining the security of your Discord and Minecraft accounts. We are not responsible for losses caused by unauthorized access resulting from your failure to secure your own credentials.
You must provide accurate information and keep your linked accounts up to date.
One person may not maintain multiple accounts to circumvent bans, rules, or restrictions.

3. The Service

FalconMC provides a Minecraft multiplayer server, a companion website, and a Discord community, offered free of charge. Chat between players is currently limited to in-game and Discord communication — there is presently no public forum or build-sharing feature on the Service.

We do not guarantee uninterrupted availability. The Service may be modified, updated, or temporarily unavailable at any time (see Section 10, "Termination and Suspension of Service").

4. Server Rules and Conduct

Use of the Service is also governed by our published Server Rules, available on the website, which are incorporated into these Terms by reference. In case of conflict between the Server Rules and these Terms on a specific point, the more specific Server Rules provision governs conduct on the server, while these Terms govern the legal relationship between you and us.

4.1 Enforcement and Bans

We enforce the Server Rules through warnings, mutes, kicks, temporary bans, or permanent bans, at our discretion, based on the severity and history of the violation.
Bans are issued based on evidence of a rule violation (e.g. logs, screenshots, plugin/anti-cheat records, staff reports) to ensure enforcement actions are valid and not arbitrary.
If you believe a ban or other enforcement action was issued in error, you may appeal by contacting us through our Discord server or at [email protected]. We will review appeals in good faith but are not obligated to reverse any enforcement decision.

5. User Content

"User Content" means any chat messages, in-game communications, or other content you submit while using the Service.

You retain ownership of your own User Content.
We do not claim any license or ownership rights over your in-game builds or chat content beyond what is reasonably necessary to operate, moderate, and secure the Service (e.g. logging chat for moderation and anti-abuse purposes).
You are solely responsible for your User Content and must ensure it complies with the Server Rules and applicable law. We may remove, mute, or take enforcement action regarding User Content that violates our rules.
If we introduce forums, build showcases, or other content-sharing features in the future, additional terms specific to that content may apply and will be communicated at that time.

6. Purchases and Monetization

FalconMC does not currently offer any paid features, ranks, cosmetics, or donations. We plan to introduce a store or donation system in the future.

Once purchases are available, the following will apply unless we state otherwise at checkout:

All purchases are final and non-refundable, except where a refund is required by applicable law.
Purchases grant a limited, revocable license to use the purchased digital item or perk within the Service; they do not transfer ownership of any intellectual property.
Access to purchased items/perks may be suspended or revoked if your account is banned for violating the Server Rules or these Terms, without entitlement to a refund.

We will update these Terms (or publish separate Purchase Terms) before any store goes live.

7. Intellectual Property

The FalconMC name, logo, and associated branding are jointly owned by FalconMC's three founders. You may not use FalconMC's name, logo, or branding for your own projects, promotions, merchandise, or any commercial or public-facing purpose without prior written permission. If you wish to use FalconMC branding (e.g. for a fan project, video, or community initiative), contact us first at [email protected] so we know about and can approve the intended use.
All original software, plugins, website code, and other materials created by FalconMC for the Service remain our property (or that of our licensors).

6a. Minecraft / Mojang Disclaimer

FalconMC is not affiliated with, endorsed by, or sponsored by Mojang Studios, Microsoft, or any of their affiliates. Minecraft is a trademark of Mojang Synergies AB. All Minecraft-related trademarks and assets belong to their respective owners.

8. Third-Party Services

The Service uses or links to third-party services, including Discord (account linking/authentication), Google reCAPTCHA (bot protection on login/registration), and Google Analytics (site analytics). Your use of these services is also subject to their own terms and privacy policies. See our Privacy Policy and Cookie Notice for details on data handling.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We do not guarantee that the Service will be secure, free of bugs, or free of data loss (e.g. in-game item/progress loss due to technical issues).

10. Limitation of Liability

To the maximum extent permitted by law, FalconMC and its founders are not liable for any damages (including but not limited to direct, indirect, incidental, or consequential damages) arising from your use of, or inability to use, the Service.

11. Termination and Suspension of Service

By you: You may stop using the Service at any time.
Of your account: We may suspend or terminate your account for violations of these Terms or the Server Rules, at our discretion, following the enforcement process described in Section 4.1.
Of the Service as a whole: If we decide to permanently shut down FalconMC, we will make reasonable efforts to notify users in advance through Discord announcements, in-game messages, and/or website alerts before shutdown occurs. This does not guarantee a minimum notice period, and does not create liability for temporary outages, maintenance, or interruptions that are not a full shutdown.

12. Governing Law and Disputes

These Terms are governed by the laws of the Arab Republic of Egypt. Any disputes arising from these Terms or your use of the Service will be subject to the jurisdiction of the competent courts of Egypt, without regard to conflict-of-law principles.

13. Changes to These Terms

We may update these Terms from time to time, for example as the Service grows or new features (like a store) are introduced. When we make material changes, we will notify users through Discord announcements, email, and/or in-site alerts. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
These Terms, together with the Server Rules, Privacy Policy, and Cookie Notice, constitute the entire agreement between you and FalconMC regarding the Service.
Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
